A Philadelphia judge has ruled that Elon Musk’s America PAC can continue its $1 million voter giveaways after dismissing an emergency petition filed by District Attorney Larry Krasner.

Krasner’s petition aimed to halt the giveaways, accusing the PAC of conducting an illegal lottery and misleading voters.

During a Monday court hearing, a representative for the PAC clarified that winners are not chosen at random but are instead selected as paid spokespeople for the PAC, which advocates for former President Donald Trump. While Musk had promoted the giveaways as random, the application form’s fine print reportedly lacks any mention of random selection.

Krasner alleged that the PAC falsely advertised the prizes as random, noting that several winners had attended Trump rallies in Pennsylvania. This detail, highlighted in court, cast doubt on the giveaways’ randomness and fueled Krasner’s claims of deceptive marketing.

The PAC has two more scheduled giveaways on its website, targeting voters in Arizona and Michigan on Monday and Tuesday. Judge Angelo Foglietta has yet to release a detailed explanation for his decision but has indicated that his rationale will be available soon.
