OpenAI has filed a lawsuit against Elon Musk, claiming that his actions hurt the company and were only meant to benefit him personally.
On Wednesday, OpenAI posted on X (formerly Twitter), saying, “Elon’s nonstop actions against us are just bad-faith tactics to slow down OpenAI and seize control of the leading AI innovations for his benefit.”
In the legal filing, OpenAI’s lawyers say that Musk’s behavior, including what they call a fake attempt to buy the company, is just a way to disrupt OpenAI’s future. They’re asking the court to stop Musk from continuing these actions and to hold him accountable for the harm he has already done.
Elon Musk helped start OpenAI but later sued the company in 2023. He said OpenAI had moved away from its original mission of creating AI that benefits all of humanity and was now more focused on making money. Some legal experts, including The Verge’s editor-in-chief, Nilay Patel, called Musk’s lawsuit “hilariously bad.”
Although Musk dropped that lawsuit in June, he filed another in August. Later in December, OpenAI responded with a blog post titled “Elon Musk wanted an OpenAI for-profit,” sharing proof of his past support for the company’s business model. The legal battle is set to go to trial in the spring of 2026.
Earlier this year, Musk also tried to buy OpenAI for $97.4 billion. He said the company should return to being open-source and focused on safety. However, OpenAI’s board rejected the offer, calling it a “sham bid” in their latest court filing.
